Sentencing- 1st Degree Murder- 1st Degree Murder carries a mandatory life sentence; a “term of years” sentence without a period of probation is illegal and must be corrected even if reached pursuant to a plea agreement.
The more interesting question is how LONG that probation should be. Both this case and the case it relies on assumed that a reasonable period of probation as of the time of the re-sentencing was acceptable.
