Sentencing- A sentence of 188 months that would have been imposed “even if the ACCA did not apply” made consideration of the ACCA challenge moot.
Facts
In 2014, McDonald illegally sold six firearms, several of which he had stolen, to an informant. Referring to one of these firearms, McDonald told the buyer that he “got this b*tch from a police officer’s crib.”
McDonald had been out of prison for less than a month at the time and was on supervised release for a previous conviction for felon in possession of firearms.
