18 USC 2423 – Sexual Conduct with Minors in Foreign Places – A defendant who flees arrest from one country to another is still traveling in “foreign commerce” for purposes of the act
18 USC 2423(c) makes it illegal for a US citizen who travels in foreign commerce to engage in “illicit sexual conduct,” defined as a sex act with a minor, commercial sex act with a minor, or child pornography.
Defendant argued his flight from the Philippines to Cambodia following his arrest there was not “foreign commerce” because he had a job in the Philippines and therefore had “settled” there. The Court disagreed.
“He has been repeatedly convicted since 1984 for extensive and grotesque sex offenses involving young boys”
