SHAUN MICHAEL BOSSE v. OKLAHOMA
Supreme Court of the United States, Per Curiam, Oct. 11, 2016,
Binding Authority – Only the Supreme Court can overrule one of its decisions
Vacating the judgment of the Oklahoma Court of Criminal Appeals, which held that Payne v. Tennessee, 501 U. S. 808 (1991) implicitly overruled an aspect of Booth v. Maryland, 482 U. S. 496 (1987).
Until the Supreme Court reconsiders its opinions, it is inappropriate for lower courts to do so on its behalf.
