§ 4-301. Exclusive original jurisdiction

 

JUVENILES

(a) District Court has exclusive original jurisdiction in a criminal case in which a person at least 16 years old or a corporation is charged with violation of the vehicle laws, or the State Boat Act, or regulations adopted pursuant to the vehicle laws or State Boat Act.

-          Concurrent with Juvenile Court on certain CINA CJP §3-803

o       Act rendering child in need of assistance CJP §3-828

o       Paternity/custody over CINA

-          At least 16 and charged with CJP § 3-8A-03

o       Non-incarcerable traffic/boating

o       Possession of regulated firearm/ammunition for regulated firearm PS § 5-133

o       Sale/rental/transfer firearm PS § 5-134

o       Sale/transfer/disposal of stolen firearm PS § 5-138

o       Short barrel rifle/shotgun PS § 5-203

o       Wear/carry handgun CR § 4-203

o       Handgun/antique firearm in commission of a crime of violence CR §4-204

o       Possess/use machine gun for an offensive/aggressive purpose CR § 4-405

o       A peace order proceeding in which the victim is a person eligible for relief

-          §4-302

o       Concurrent with juvenile on school attendance

o       District Court can have jurisdiction if juvenile court waives

GENERAL

§         Criminal case with max penalty 3 years or $ 2,500

§         That is a felony, as provided in § 4-301(b)(2), (6), (7), (8), (9), (10), (11), (12), (13), (14), (15), (16), (17), (18), (19), (20), (21), (22), and (23) of this subtitle

o       Exclusive on

§         Controlled paraphernalia and possession of CDS

·         Unless JTP or Appeal or joined with other offense within circuit’s jurisdiction

o       District Court also has exclusive original jurisdiction in a criminal case in which a person at least 18 years old or a corporation is charged with:

§         Commission of a common-law or statutory misdemeanor regardless of the amount of money or value of the property involved;

·         Includes traffic CJP §4-101

§         Violation of § 7-104, § 7-105, § 7-107, or § 7-108 of the Criminal Law Article, whether a felony or a misdemeanor;

·         Theft §7-104

·         Motor vehicle theft §7-105

·         Bad Checks §7-107

§         Violation of a county, municipal, or other ordinance, if the violation is not a felony

§         Criminal violation of a State, county, or municipal rule or regulation, if the violation is not a felony;

§         Doing or omitting to do any act made punishable by a fine, imprisonment, or other penalty as provided by the particular law, ordinance, rule, or regulation defining the violation if the violation is not a felony;

§         Violation of § 8-103 of the Criminal Law Article, whether a felony or a misdemeanor;

·         Obtaining property/services by bad check

§         Violation of §§ 8-203 through 8-209 of the Criminal Law Article, whether a felony or misdemeanor;

·         Credit card theft/fraud

§         Forgery or violation of Title 8, Subtitle 6 of the Criminal Law Article, whether a felony or misdemeanor;

·         Counterfeiting and related crimes

§         Violation of Title 27, Subtitle 4 of the Insurance Article, whether a felony or a misdemeanor;

§         Violation of § 9-1106 of the Labor and Employment Article;

·         False claims regarding work compensation

§         Violation of § 8-301 of the Criminal Law Article, whether a felony or misdemeanor;

·         Identity fraud

§         Violation of § 2-209 of the Criminal Law Article;

·         Manslaughter by vehicle or vessel

§         Violation of Title 2, Subtitle 5 of the Criminal Law Article;

·         Homicide by motor vehicle or vessel while impaired or under the influence

§         Violation of Title 11, Subtitle 5 of the Financial Institutions Article;

·         MD Mortgage Lender Law

§         Violation of §§ 10-604 through 10-608 of the Criminal Law Article, whether a felony or misdemeanor;

·         Animal abuse

§         Violation of Title 7, Subtitle 3, Part III of the Criminal Law Article, whether a felony or misdemeanor;

·         Telecommunication Service Providers

§         Violation of § 20-102 of the Transportation Article, whether a felony or misdemeanor;

·         Hit & Run – Bodily injury or death

§         Violation of § 8-801 of the Criminal Law Article;

·         Financial exploitation of vulnerable

§         Violation of § 8-604 of the Criminal Law Article;

·         Counterfeit US Currency

§         Violation of Title 8, Subtitle 2, Part II of the Criminal Law Article;

·         Credit card number protection

§         Violation of §§ 16-801 through 16-804 of the Election Law Article;

·         Tamper voting equipment

§         Violation of § 3-203(c) of the Criminal Law Article; or

·         Assault 2nd on police officer

§         Violation of § 11-303(b) of the Criminal Law Article.

·         Human trafficking - minor
